1. About This Policy
This Privacy Policy explains how Red Umbrella Home & Garage Contractors (“Red Umbrella,” “we,” “our,” “us”) collects, uses, shares, and protects information when you visit redumbrellaservices.com (the “Site”), contact us, request an estimate, or use our AI assistant. Red Umbrella is a licensed general contracting business owned by Bari Swartz and based in Eugene, Oregon, serving homeowners across Lane County and the southern Willamette Valley.
We’ve written this policy in plain language because we want you to actually understand it. By using the Site, you agree to the practices described here. This policy applies to our Site and the related services we provide — it does not apply to third-party websites we may link to, each of which has its own privacy practices. If you do not agree with this policy, please do not use the Site.
2. Information We Collect
We collect information in three ways: what you give us, what we gather automatically, and what we receive from third parties.
Information you provide directly
When you submit a contact or estimate form, request a consultation, call or email us, or chat with our assistant, you may give us your name, phone number, email address, property address or city, and details about your project — for example the type of work (custom garage, garage conversion, ADU, or home addition), your budget range, your timeline, and notes about your home. You decide what to share; if you leave a field blank, we simply won’t have it.
Information collected automatically
Like virtually all websites, we automatically collect limited technical and usage data through cookies and analytics tools. This may include your IP address (which indicates an approximate city-level location), your browser type and version, your device type and operating system, the pages you view and links you click, the website or search that referred you, and the dates, times, and duration of your visits. This information is aggregated and statistical; we use it to understand how the Site performs and how to improve it.
Information from third parties
If you reach us through an online directory, advertisement, or review platform — such as Google, Facebook, or Yelp — we may receive the basic information you have made available through that platform, such as your name and the message you sent us. If you apply for financing through a partner, that partner shares with us only what is needed to coordinate your project.
3. Information We Do Not Collect
We do not ask for, and you should never enter into our Site or chat assistant, sensitive information such as Social Security numbers, driver’s license numbers, full payment-card or bank-account numbers, or health information. We do not knowingly collect this data, and we don’t need it to answer your questions or schedule a consultation. Payment for any project is handled separately under your written agreement, not through this website.
4. How We Use Your Information
We use the information we collect only for legitimate business purposes, including to:
- Respond to your inquiries and prepare free estimates;
- Schedule, plan, permit, and perform the work you request;
- Communicate with you about your project, appointments, and questions;
- Provide and improve our Site, content, and customer experience;
- Maintain the security and integrity of the Site and prevent spam, fraud, and abuse;
- Keep accurate business records and comply with legal, tax, licensing, and regulatory obligations; and
- Send occasional updates or promotions — only if you have asked us to, and you can opt out anytime.
We do not use your information to make automated decisions that produce legal or similarly significant effects about you, and we do not engage in profiling for those purposes.
Text messaging (SMS)
If you check the “OK to text” box on one of our forms, you consent to receive SMS/text messages from Red Umbrella at the mobile number you provide, about your project, scheduling, estimates, and related follow-up. Consent is not a condition of any purchase or service. Message frequency varies; message and data rates may apply. You can opt out at any time by replying STOP to any message, or reply HELP for help. We do not sell or share your mobile number or your SMS consent with third parties or affiliates for their own marketing.
5. The Tess AI Assistant
Our Site offers an optional chat assistant named “Tess” to help you get quick answers and request a consultation. Because Tess uses artificial intelligence, we want to be transparent about exactly how it handles your information.
How Tess works
Tess is powered by Claude, a large language model developed by Anthropic. When you type a message, that message is securely transmitted to Anthropic’s API, which generates a response that is then displayed to you. Tess is available only on our website and only when you choose to open it.
What Tess collects
Tess processes the content of your chat messages and any details you choose to share. If you ask to schedule a consultation or request a quote, Tess may collect your name, phone number, email address, and project details and forward them to our team as a lead so we can follow up with you.
How the AI provider handles your data
Under Anthropic’s commercial API terms, your conversation data is not used to train Anthropic’s models, and it is retained only as long as needed to provide and secure the service. You can review Anthropic’s privacy practices on their website. We use Tess to help you, not to harvest data.
Please don’t share sensitive information
Tess is designed for general questions and scheduling. Please do not enter passwords, payment-card or bank-account numbers, Social Security numbers, or other sensitive personal information into the chat.
Tess’s limitations
AI assistants can be wrong. Any pricing, code rules, timelines, or availability Tess provides are general estimates for guidance only — they are not binding quotes, professional advice, or guarantees. Always confirm important details with Bari before relying on them.
6. How We Share Information
We treat your information as confidential. We do not sell, rent, or trade your personal information to anyone. We share it only in these limited situations:
- Service providers. We work with trusted vendors who operate our Site and business on our behalf — including web hosting, email and SMTP delivery, analytics, and the AI provider behind Tess. They may access your information only to perform services for us, under confidentiality obligations, and only as needed.
- Project partners. To perform work you’ve requested, we may share relevant details with subcontractors, engineers, suppliers, lenders you’ve chosen, or the permitting authority — limited to what each needs to do their part.
- Legal and safety. We may disclose information when required by law, subpoena, or legal process, or when necessary to protect the rights, property, or safety of you, our team, or the public.
- Business transfers. If our business is ever sold, merged, or reorganized, customer information may be transferred as part of that transaction, subject to this policy.
7. Third-Party Services & Links
Our Site relies on third-party services that may process limited data under their own privacy policies. These include our web host, Google Analytics (usage analytics), Anthropic (the Tess assistant), and — only if you choose to apply — financing partners such as HFS Financial. Our Site may also contain links to other websites (for example a manufacturer, a review platform, or a financing partner). We are not responsible for the content or privacy practices of websites we do not operate, and we encourage you to read their policies before sharing information with them.
8. Cookies & Tracking Technologies
Cookies are small text files stored on your device that help websites function and remember preferences. We use a limited set of them.
Types of cookies we use
- Essential cookies are necessary for the Site to work and to remember your choices, including your accessibility-toolbar settings and your cookie-consent selection.
- Analytics cookies help us understand how visitors use the Site — which pages are popular and where people may get stuck — so we can improve it. These are typically provided by Google Analytics.
Managing cookies
When you first visit, our cookie banner lets you accept or decline non-essential cookies. You can also block or delete cookies at any time through your browser settings, and most browsers let you refuse cookies entirely. Please note that blocking essential cookies may affect how parts of the Site work.
9. Data Retention
We keep your information only as long as we have a legitimate reason to. Contact and project information is retained while we are providing services and for a reasonable period afterward — so we can honor warranties, answer follow-up questions, maintain accurate business and tax records, and meet legal requirements. When we no longer need it, we delete or anonymize it. Website analytics data is retained according to our analytics provider’s default retention settings.
10. Data Security
We take reasonable steps to protect your information using a combination of administrative, technical, and physical safeguards. Our Site is served over encrypted HTTPS connections, access to customer information is limited to people who need it, and we work with reputable service providers who maintain their own security practices. That said, no method of transmitting or storing data over the internet is completely secure, so while we work hard to protect your information, we cannot guarantee absolute security. If we ever become aware of a security incident affecting your personal information, we will respond in accordance with applicable law.
11. Your Privacy Choices & Rights
You are in control of your information. At any time you may:
- Opt out of marketing by using the unsubscribe link in any email or by contacting us;
- Ask what we hold — request a summary of the personal information we have about you;
- Correct or update inaccurate information;
- Request deletion of your information, subject to records we must keep by law; and
- Decline cookies through our banner or your browser.
To exercise any of these, email [email protected] or call (541) 515-3843. We will respond within a reasonable time, generally within 45 days, and we may need to verify your identity before acting on a request. We will never charge you or treat you differently for exercising these rights.
12. Oregon Resident Rights (OCPA)
The Oregon Consumer Privacy Act (OCPA) gives Oregon residents specific rights over their personal data. Subject to the law’s conditions and exceptions, you have the right to:
- Confirm whether we process your personal data and access that data;
- Obtain a copy of your data in a portable, usable format;
- Correct inaccuracies in your data;
- Delete your personal data; and
- Opt out of the sale of personal data, targeted advertising, and certain profiling.
We do not sell personal data, and we do not use it for cross-context targeted advertising or for profiling that produces legal effects. To submit a request, contact us at [email protected]. If we deny a request, you may appeal by replying to our response; if you have concerns about our handling of an appeal, you may contact the Oregon Department of Justice. We will not discriminate against you for exercising your rights.
13. Visitors From Other States
While we are an Oregon business serving Oregon homeowners, visitors from other states are welcome on our Site. If you are a California resident and the California Consumer Privacy Act applies to your interaction with us, you may have similar rights to know, delete, correct, and opt out of the “sale” or “sharing” of personal information — which, again, we do not do. Residents of other states with privacy laws may have comparable rights. To make any such request, contact us using the information below and tell us your state of residence.
14. Do Not Track Signals
Some web browsers offer a “Do Not Track” (DNT) setting that sends a signal to websites you visit. Because there is currently no industry-standard or legal consensus on how to interpret DNT signals, our Site does not respond to them at this time. We do, however, honor the cookie-consent choices you make using our banner, and we limit our tracking to the essentials described above.
15. Children’s Privacy
Our Site and services are intended for adults — homeowners and property owners who are at least 18. We do not direct our Site to children and do not knowingly collect personal information from anyone under 13. If you believe a child has provided us with personal information, please contact us and we will promptly delete it.
16. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or the law. When we do, we’ll revise the “Last updated” date at the top, and the current version will always live on this page. For significant changes, we’ll make the update clear. Your continued use of the Site after an update takes effect constitutes your acceptance of the revised policy, so we encourage you to review it periodically.
